Trend of Tokenization Series: German Regulation on Utility Tokens and ICOs

The other structured forms of crypto-assets have been recognized in this guidance, and they are predominantly segregated into three types of tokens:

1) Exchange tokens;

2) Security tokens;

3) Utility tokens.

Simultaneously, European Financial Services Authority (ESMA) essentially addresses the suitable risk-disclosure for the European entities.

Furthermore, a draft bill is intended to contemplate public feedback on the issues as German politicians begin observing as to how the regulatory framework should be framed for Initial Coin Offerings (ICOs) precisely and for the gamut of cryptocurrencies as well.

Whether a token offering is a security, that is subject to the circumstances with the London based Bird & Bird international law firm giving a breakdown of the potential considerations, according to Germany’s financial regulator, BaFin.

Whether ICOs or utility token has to abide by some basic requirements, though BaFin is not applicable if they’re raising under $20 million. Just in case, it exceeds these levels, then a green-light is quite essential.
