The complaint accuses the defendants of violations of the Securities Exchange Act of 1934 by virtue of the defendants’ failure to disclose during the Class Period that the Company’s wholly-owned subsidiary, Arriva Medical, LLC (“Arriva”), was submitting claims to Medicare for deceased patients, which subjected Arriva to revocation of its Medicare enrollment.
According to the complaint, following a November 4, 2016 announcement that the Centers for Medicare and Medicaid Services alleged that Arriva submitted claims for 211 deceased patients over a five-year period, and thus revoked Arriva’s Medicare enrollment, the value of Alere shares declined significantly.
