Fierce rivals Shein and PDD Holdings-owned Temu have agreed to end their legal battles in the U.S., according to documents filed in court. This surprising development comes amid an intensifying global market share competition between these two low-price online platforms.
Ceasefire Declared, Reasons for Dismissal Unclear
Joint declarations were submitted to courts in Chicago and Boston by lawyers representing Shein, Temu, and their subsidiaries, as per Reuters. The legal representatives have requested the dismissal of two ongoing cases "without prejudice" by the respective judges. Tech.co noted that this move marks a legal ceasefire between the warring brands.
While the legal disputes are being resolved, the motives behind the decision remain unclear. Neither Shein nor Temu has explained this seemingly coordinated move and no settlements have been made.
The filings lack details regarding the withdrawal of complaints or any potential settlements. Currently, both companies have yet to respond to requests for comments on the recent court filings.
Background on Lawsuits
Shein had previously filed a lawsuit against Temu in December, citing instances where Temu allegedly instructed social media influencers to make negative remarks about the fast-fashion retailer. Additionally, Shein claimed that Temu used "imposter" social media accounts to deceive customers into downloading the Temu app.
In response, Temu retaliated with its lawsuit in July, accusing Shein of violating U.S. antitrust laws in its dealings with clothing manufacturers. Temu alleged that Shein forced manufacturers to sign loyalty oaths explicitly stating they would not do business with Temu.
Both Shein and Temu vehemently denied any wrongdoing in their respective cases. While these legal disputes have caused a significant disruption in the global retailing landscape, it is important to note that both companies have embraced an ultra-fast fashion, low-price shopping model.
With the legal battles now at rest, the question arises about how this resolution will impact the market share competition between Shein and Temu.
