US under Trump Series: Ban on Trump’s immigration ban upheld by court

Trump administration suffered a second major setback as the Appeals Court upheld the freeze on Trump’s travel ban. The judges of the US Ninth Circuit Court of Appeals rejected the government’s core argument that the president’s power over immigration lies beyond judicial review, noting that the Supreme Court repeatedly has dismissed similar claims. In the very first week of his Presidency, Donald Trump signed an executive order banning the entry of immigrants from seven Muslim-majority countries in the Middle East and North Africa; however, a lower court declared a freeze on the ban triggering debates on the Presidential powers. Trump administration had argued based on 1182(f) of the immigration law, that the law and the constitution give the President the power to sign such ban. But the three judges said in their 29-page ruling that there is no precedent to support this claimed un reviewability that runs against the structure of the constitutional democracy.

Moments after the court decision was made public, a furious Donald Trump tweeted, ““SEE YOU IN COURT, THE SECURITY OF OUR NATION IS AT STAKE!”. Speaking to NBC news, he further added that it was a political decision and concluded that his government is going to win the case. The case would now likely to move to the Supreme Court.
