According to the lawsuit, throughout the Class Period defendants issued false and misleading statements to investors and/or failed to disclose that: (1) Orbital lacked effective control over financial reporting; (2) Orbital failed to record an anticipated loss on a $2.3 billion long-term contract with the U.S. Army to manufacture and supply small caliber ammunition at the U.S. Army’s Lake City Army Ammunition Plant after the loss became evident in 2015, as required by generally accepted accounting principles; and (3) as a result, defendants’ statements about Orbital’s business, operations and prospects were materially false and misleading and/or lacked a reasonable basis at all relevant times. When the true details entered the market, the lawsuit claims that investors suffered damages.
A class action lawsuit has already been filed. If you wish to serve as lead plaintiff, you must move the Court no later than October 11, 2016. A lead plaintiff is a representative party acting on behalf of other class members in directing the litigation.
