The United States International Trade Commission (ITC) will make its final ruling on the patent infringement case filed by SK Innovation against LG Chem over electric vehicle (EV) batteries on Nov 30, 2021.
The new LG EV battery firm to be separated from LG Chem will absorb the burden of the ruling.
The case was originated from a lawsuit filed by LG Chem against SK Innovation with the ITC and a Delaware court for stealing its key process technology for battery manufacturing.
SK Innovation responded with a patent infringement suit, which caused a follow-up suit from LG Chem.
In September 2019, SK Innovation sued LG Chem for selling batteries that based on its patented 994 technology in the US.
The ITC has scheduled hearings over the 994 patent infringement case for five days on March 15 to 19, 2021, and a preliminary ruling on July 30, 2021.
The ITC will also rule on a trade secret infringement case filed by LG Chem against SK Innovation on Dec. 10.
The ITC had ruled against SK Innovation in its preliminary decision in February.
Final ITC rulings will be delivered on Jul. 19, 2021 over the case filed by LG Chem against SK Innovation.
