JACKSONVILLE, Fla., March 01, 2016 -- ParkerVision, Inc. (NASDAQ:PRKR) (the “Company”) announced today that on February 29, 2016, it filed a petition for a Writ of Certiorari with the Supreme Court of the United States (“SCOTUS”) requesting a review of the decision of the United States Court of Appeals for the Federal Circuit in ParkerVision v. Qualcomm. ParkerVision is represented by Thomas C. Goldstein, Goldstein & Russell, P.C.
The question that ParkerVision is requesting the SCOTUS to review is “whether and under what circumstances an inconsistency in expert testimony permits a court to set aside a jury verdict and grant the losing party judgment as a matter of law.” A copy of the full petition can be found on ParkerVision’s website at: http://www.parkervision.com/company/public_relations/PatentCase_PDFs/PV_Q_USSC_05.pdf.
ParkerVision’s Chairman and Chief Executive Officer, Jeffrey Parker, commented, “The question posed in our Supreme Court petition is not only an important one for ParkerVision, but an important one for all plaintiffs, particularly innovators who have made significant investments in patented technologies, who believe their innovations are protected by the US patent system, and who rely on the Seventh Amendment guarantee of the right to trial by civil jury and the sanctity of the jury verdict to resolve patent disputes. The large number of jury verdicts reversed by the Federal Circuit in recent years contributes to an environment of uncertainty which threatens the future of innovation. We believe this is a critical issue in today’s patent environment, and the Supreme Court’s acceptance of our petition will be an indication that the highest court recognizes the importance of providing guidance on the appropriate role of the jury and the judge.”
