The Ministry of Justice has issued an advance legislation notice to the revision of the Act on the Use of Electronic Documents in Civil Procedures.
Current laws require litigants to personally submit their litigation documents such as land registration, building registration, and certificate of corporate registration details after issuance of hard copies by the administrative agencies and public institutions concerned.
The revision enables the litigants to request that these institutions submit digital versions of the documents on their behalf.
The revision mandates that the heads of the institutions should comply with the requests as long as there is no legitimate reason to object.
Such a system will likely be put in place from 2024 when the court will complete the establishment of a next-generation e-litigation system.
According to the ministry, the revision will save time and costs for those preparing for litigation, and help create a paperless work environment for administrative agencies and public institutions.
