Long-awaited 22% virtual-asset gains tax in South Korea is formally set to go into effect on January 1, 2027, therefore giving 13 million crypto investors and local exchanges a short runway to get ready. The National Tax Service (NTS) said in November 2026 that thorough execution guidelines will be released. Within the system, profits from transferring or loaning virtual assets will be categorized as "other income" and subject to an effective tax rate of 22% (comprising 20% national income tax and 2% local income tax) following a yearly deduction of KRW 2.5 million (about USD 1,800 to 1,900).
Though the deadline is near, important operational and structural issues ahead of the November advice are still open. At a parliamentary meeting on October 13, NTS Commissioner Lim Gwang-hyun said that major gaps still had to be filled, including determining the tax treatment for staking, airdrops, and DeFi activity, figuring out historical cost basis for assets acquired over many wallets, and developing clear loss-offset techniques. While market players face possible asset realignment or profit-taking before the launch, exchanges including Upbit, Bithumb, Coinone, Korbit, and Gopax are competing to match data systems with the NTS.
Political unrest still shadows the introduction since this is South Korea's fourth try to apply the tax after three earlier delays. The January 2027 start date is still fixed under current legislation but lacks total political assurances, given a petition with 50,000 signatures and a legislative bill seeking to totally remove crypto income from the Income Tax Act. Whether the market has a seamless transformation or suffers more friction and calls for more delays will finally be decided by the impending November legislation advice.
