With daily talks adding more than 300 pages to the measure, Senator Cynthia Lummis keeps pushing Senate leaders to pass the Digital Asset Market CLARITY Act before the August recess starts after August 7–8. Though she is hopeful about obtaining Democratic backing, the Senate calendar indicates no cloture filing as of August 5 and no official vote has been set, therefore raising questions about the timing despite aims to save floor time.
There are several issues with the bill, including the split of power between the SEC and CFTC, ethical and enforcement standards, defenses against illegal finance, and regulations on stablecoin yields. Getting through the Senate would call for 60 votes to get over a filibuster; hence, seven Democrats would have to join the 53 Republicans in backing cloture.
A positive vote would send a strong bullish indicator for the crypto markets by lowering legal ambiguity; failure or further delay might cause disappointment and move settlement into September, close to the midterms. An official cloture filing or official calendar from Majority Leader John Thune rather than constant statements of intention remains the ultimate indicator.
