The rejected plan, mostly supported by the Green Party, aimed to get rid of the well-known one-year holding-period exemption. Investors who keep their cryptocurrency for more than 12 months (the "Haltefrist") can sell their possessions totally tax-free under current German law, a regulation that has turned the nation into a major center for long-term crypto holders.
The committee's choice is a major success for the crypto sector since it maintains the capacity of people to earn long-term revenues free from capital-gains tax. But the triumph could be short-lived; Finance Minister Lars Klingbeil and the SPD continue to push for a flat 25% tax rate on all cryptocurrency transactions, independent of asset holding period. This suggested modification would bring cryptocurrency taxes in line with those on conventional equities and funds, and it continues to be a major source of disagreement in the developing federal budget framework for 2027.
Although the Finance Committee's refusal indicates significant political opposition to quick tax increases, the argument is far from done. Lawmakers anticipate the subject reappearing later this year either through the larger budgetary process or through individual legislative measures. Although German investors can profit from the 12-month rule for the time being, the ongoing pressure from the SPD indicates that the window for tax-free cryptocurrency trading in Germany may experience new difficulties as the government searches for fresh revenue streams.
