A federal judge on Thursday ordered President Donald Trump’s administration to temporarily restore White House press access for journalists from CNN, MS NOW and Politico, ruling that the administration’s ban on the three news organizations was unconstitutional.
U.S. District Judge Tim Kelly issued the order after the media organizations filed a lawsuit challenging Trump’s September 18 decision to revoke their White House access.
Under the ruling, the Trump administration must immediately reinstate the outlets’ press passes. Kelly also temporarily blocked White House officials from enforcing the ban for 14 days while the legal dispute continues.
The judge rejected the administration’s argument that restricting the three news organizations was justified by national security concerns.
Trump had accused CNN, MS NOW and Politico of repeatedly publishing what he described as “FICTION and LIES.” Justice Department attorneys subsequently defended the restrictions in court on national security grounds.
CNN, MS NOW and Politico responded by filing a lawsuit against Trump and members of his administration in federal court in Washington on Monday. The news organizations argued that excluding their journalists from the White House violated constitutional protections for the press.
The dispute has also drawn opposition from other news organizations. Several media outlets, including Fox News, boycotted the White House in protest against the administration’s decision to bar the three organizations.
Kelly’s temporary order represents a legal setback for the Trump administration in its dispute with major U.S. media organizations. For at least the next 14 days, journalists from CNN, MS NOW and Politico will be permitted to regain their White House credentials and access.
The broader lawsuit remains pending, meaning the court will still have to consider the underlying constitutional issues surrounding White House press access and the administration’s authority to restrict individual news organizations.
